Two new rental programmes are legally in force but still need operating rules

Portugal's Rent to Sublet and Build to Rent programmes took legal effect on 1 September, but their practical application depends on implementing regulations that have not yet been published.

IN BRIEF

Tenants, owners and developers should not treat the start date in the law as proof that applications, contracts or incentives are already available.

  • Decree-Law 97/2026 created the Arrendar para Subarrendar and Construir para Arrendar frameworks.
  • The legal start date was 1 September 2026.
  • Key operational details depend on ministerial regulations.
  • A future application should be assessed from the official notice and contract, not from the programme name alone.
01

What the two models are intended to do

The Rent to Sublet model is designed around public entities leasing homes from owners and then subletting them under programme conditions. The Build to Rent model is intended to support the creation of housing kept in the rental market rather than sold immediately.

Those descriptions explain the policy direction, not the full commercial or eligibility terms. Rent limits, guarantees, procedures, eligible projects and the responsibilities of each party must be read from the implementing rules and individual notices.

02

Why the missing regulation matters

A law can enter into force before the forms, portals, detailed criteria or contract templates needed to operate it are ready. Until the required regulations are published, an interested person may be able to research the framework but not complete a valid application.

Be cautious with anyone offering guaranteed admission or asking for a non-refundable fee before an official application route exists. Owners should also compare the final contract with an ordinary lease, including payment security, maintenance, insurance, duration and exit conditions.

WHAT TO DO NEXT

What you can do now.

  1. 01

Monitor the Housing Portal and Diário da República for the implementing regulations.

  2. 02

Do not pay an intermediary merely to reserve an undefined programme place.

  3. 03

Have the final contract and tax treatment checked before committing a property.
